1. INTRODUCTIONThese Terms and Conditions govern your use of the website www.thecontrastgarden.com and your participation in any sessions, classes, memberships or packages offered by The Contrast Garden Sdn Bhd ("The Contrast Garden", "we", "us", "our").By booking a session, purchasing a package or membership, or using our website, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.
2. ELIGIBILITY
2.1 You must be at least 18 years of age to use our services unless accompanied by an adult.
2.2 By booking, you confirm that you are in good health and are not aware of any medical condition that would make participation in sauna, cold plunge, breathwork or physical exercise unsafe for you.
2.3 If you have any pre-existing medical conditions including but not limited to cardiovascular disease, high or low blood pressure, respiratory conditions, pregnancy, epilepsy or are under medical supervision, you must consult your doctor before participating. You participate entirely at your own risk.
3. BOOKINGS
3.1 All bookings are subject to availability and are only confirmed upon receipt of full payment unless otherwise agreed.
3.2 Community sessions are shared experiences. By booking a community session, you accept that other participants will be present in the same space.
3.3 Private session bookings reserve exclusive use of one area for the duration of your session.
3.4 The Contrast Garden reserves the right to refuse entry or remove any participant whose behaviour is deemed unsafe, disruptive or disrespectful to other guests or staff.
4. PAYMENTS
4.1 Payments are accepted via Stripe (credit/debit card), FPX, GrabPay, and cash on arrival.
4.2 All prices are in Malaysian Ringgit (RM) and are inclusive of applicable taxes where stated.
4.3 Packages and memberships are non-transferable and may not be shared between individuals unless explicitly stated.
4.4 The Contrast Garden reserves the right to amend pricing at any time. Changes will not affect bookings already confirmed.
5. CANCELLATIONS AND REFUNDS5.1 Cancellations made more than 24 hours before a session will receive a full credit to be used for a future booking.
5.2 Cancellations made within 24 hours of a session are non-refundable and non-transferable.5.3 No-shows will be treated as late cancellations and are non-refundable.
5.4 The Contrast Garden reserves the right to cancel or reschedule sessions due to circumstances beyond our control including but not limited to adverse weather, equipment failure or insufficient bookings. In such cases, a full credit or refund will be offered.
5.5 Packages and memberships are non-refundable once purchased except where required by Malaysian consumer protection law.
6. MEMBERSHIPS AND PACKAGES
6.1 Memberships and packages are valid for the period stated at the time of purchase.
6.2 Memberships are non-transferable and are for the named member only.
6.3 The Contrast Garden reserves the right to suspend or terminate a membership where these Terms and Conditions have been breached.
6.4 Membership fees will be charged on a recurring basis as agreed at the time of purchase. It is your responsibility to ensure payment details are kept up to date.
7. HEALTH AND SAFETY
7.1 You participate in all sessions entirely at your own risk. The Contrast Garden accepts no liability for injury, illness or death arising from participation in our sessions except where caused by our negligence.
7.2 You must follow all instructions given by staff at all times.
7.3 You must inform staff of any medical conditions or injuries before participating.
7.4 The use of alcohol or drugs before or during sessions is strictly prohibited.
7.5 The Contrast Garden maintains hygiene standards across all facilities. Our cold plunge units operate with both UV and ozone cleaning systems.
8. LIABILITY
8.1 To the fullest extent permitted by Malaysian law, The Contrast Garden shall not be liable for any indirect, incidental, special or consequential loss or damage arising from your use of our services or facilities.
8.2 Our total liability to you in connection with any claim shall not exceed the amount paid by you for the session or service in question.
8.3 Nothing in these Terms and Conditions limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
9. INTELLECTUAL PROPERTY
9.1 All content on www.thecontrastgarden.com including text, images, logos and branding is the property of The Contrast Garden Sdn Bhd and may not be reproduced without prior written consent.
10. GOVERNING LAW
10.1 These Terms and Conditions are governed by the laws of Malaysia.
10.2 Any disputes arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Malaysia.
11. CHANGES TO THESE TERMS
11.1 We reserve the right to update these Terms and Conditions at any time. Changes will be posted on our website with an updated date. Continued use of our services following any changes constitutes your acceptance of the new terms.
